CASA Bon Aire -Terms and conditions

1. Rental agreement
The property known as Casa Bon Aire in Calpe is offered for holiday rental on behalf of the owner RUMMENS Frank (later referred to as the owner) to the renter (the Client) named as the party leader on the booking form. All bookings are accepted by the owner and are subject to these conditions, which are deemed to have been accepted in full by the client and all persons in the party.
2. Confirmation
Bookings by E mail will be confirmed by another E mail with the rental agreement the client has to sign and send back by E mail to the owner with a copy of his passport or ID card. The villa will be held in option for a period of 3 working days from the moment the owner sends the “Rental Agreement” to the renter. During this time, the client must ensure to transfer the booking deposit by bank. Failure to do so will mean the villa will become available to others for booking.
3. Payment
A booking deposit of 30% of the total villa rental cost as well as the cost for linen, towels and final cleaning is payable at the time of booking. An invoice will be sent by E mail as soon as the booking deposit is cleared by bank transfer and will state the balance due date. The balance plus a Refundable Security Deposit of € 250.00 (See Clause 14) is to be paid 8 weeks prior to arrival. If the rental period is less than 8 weeks away, the Full Rental plus the Refundable Security Deposit €250 is due at time of booking. If the owner does not receive this payment by the balance due date specified on the booking confirmation and has no notification from the client, the booking will automatically be cancelled and the deposit will be retained. Payment processing fees will be charged to tenant. Transfers via IBAN bank accounts are free of charge. It is recommended not to book travel arrangements until receipt of booking confirmation.
4. Cancellation by Client
All cancellations of bookings must be notified by E mail. The date of the cancellation will take effect upon the date of receipt of the notice. If the owner receives notification of cancellation eight full weeks prior to arrival date, only the deposit will be forfeited. If cancellation is less than eight full weeks before arrival then the full rental cost is to be paid as laid down in clause 3.
5. Amendments
Any amendment to a confirmed booking, requested by the Client within the eight week period will incur a € 30.00 charge in addition to the increase, if any, in cost of the revised arrangements.
6. What is Included?
The villa rental includes lodging for maximum 6 persons, the cost of normal use of water (5 m³/week), electricity (100 kWh/week), gas for warm water (0,5 m³/week), Wi Fi, cot and high chair when reserved, maintenance of swimming pool & garden. The kitchen is fully equipped with hob, fridge/freezer, microwave, dishwasher, coffee maker, crockery and cutlery. The outside kitchen offers the use of a washing machine, a dryer, an iron, an ironing board,… In the storage room, you will find a vacuum cleaner and cleaning things.
7. What is not included?
The villa rental price does not include any personal insurance, travel insurance, transportation nor airport transfers. Rent of linen and towels is compulsory: € 20.00/person/stay. Final cleaning is compulsory: € 150.00/stay. The cost of occasional overconsumption of water €5.00/m³ – of electricity €0.30/kWh and of gas for central heating in winter €5.00/m³. Both upon arrival and departure, meter readings will be recorded. (Attention: do not use air conditioning with open windows/doors!)
The cost of gas used for the central heating in winter period is not included.
When you arrive on the first day of your holiday after 11 pm. or you arrive on a Sunday, an extra of € 15 must be paid to our local representative when you check in, as well as when you leave before 7:00 am. or on Sunday departure.
8. Complaints
In the unlikely event that there is a complaint about the villa or its contents during the stay, it must be reported immediately by phone to the owners’ local representative who will take reasonable steps to solve the matter. Neither the owner nor his representatives shall have any liability for any complaint submitted after the booking period.
9. Occupancy
The villa will be ready for occupancy from 4pm on the rental start date. Upon arrival, the client controls if the villa and the inventory is complete and undamaged. Damaged or missing things should be reported to our representative within 24 hours of arrival, who will do every effort to repair or replace.
The villa must be vacated by 10 am on the rental end date to allow time to clean and prepare for the new arrivals. Our representative will make an inspection of the house to confirm the inventory and that everything is in order. Upon departure it is the clients’ responsibility to ensure that all remote controls for TV, satellite decoder, radio, air conditioning units and keys of the doors and garage are left inside the villa.
10. Maximum Number of Persons
Under no circumstances, more than 6 persons specified in the rental agreement may occupy the villa except by prior written agreement. The villa cannot be re-let/sublet to any other group/party without the written approval of the owner. The owner and his representatives reserve the right to refuse admittance to the villa to the client and their party if they are in breach of any of these conditions. On arrival, the client will be asked to identify by means of showing the rental agreement and passports of all members of the party.

11. Clients’ Responsibilities
The client is responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, fixtures, furnishings, fittings, etc., must be left in a similar condition of cleanliness as at the beginning of the rental period. The client understands that the villa is not a hotel. There is only a final cleaning and no daily housekeeping. He must ensure a satisfactory clean and tidy condition upon departure so he should also ensure that dishes are done, the dishwasher is empty, all kitchen appliances and the barbeque are cleaned and ready for the next clients. The client should also ensure that full inventory is on its intended place and that all household waste is bagged and all bottles, cans, plastics, cardboard and paper are taken to the waste/recycling bins along the street (location: see house rules). Excessive cleaning costs and costs for re-organizing the inventory will be deducted from the Security Deposit.
The client shall ensure that no member of the party engages in any activity in or around the swimming pool, which may cause offence to neighbors or pollution to the water or damage to the structure or filtration equipment. This also includes unacceptable anti-social behavior.
Finally, the client ensures that no item at all is removed from the villa.
12. Insurance
The villa rental cost does not include any personal insurance cover of any kind. It is strongly recommended that the renter takes out insurance coverage for himself and the party against holiday cancellation, personal accidents and medical costs (= a full travel insurance).

13. Damage to the Villa

Except in the case of normal wear & tear the client will be responsible for making good any damage to the villa or its contents, which has occurred due to negligence, willful damage or irresponsible behavior on the part of those occupying the villa or their guests. Such damage must be reported without delay to the owners’ local representatives or directly to the owner. The cost of the repair or replacement must be agreed with and paid for. All disputes between owner and client is governed by Belgian law.

14. Refundable Security deposit

A security deposit of € 250.00 is held against damage to the property, furnishings, occasional overconsumption or for excessive cleaning requirements or re-organizing of inventory. If upon departure, the state of cleanliness of the villa is satisfactory, if there is no occasional overconsumption of electricity (over 100 kWh/week) nor an occasional overconsumption of water (over 5 m³/week) or gas for warm water (over 0,5 m³/week), and if nothing is damaged, lost or broken, the security deposit will be returned to the client within two weeks after departure. The owner reserves the right to replace or repair any breakage and to deduct the costs from the security deposit accordingly. Breakage, loss or damage may postpone the security deposits refund until the repair/replacement has been done. If the security deposit is insufficient to cover repair/replacement costs, the client is liable to pay any additional costs.

15. Right of Access
The owner, his representatives or their sub-contractors have the right of access to the property at any time with due regard to the convenience of the client respecting his privacy for the purpose of inspection of the property and to carry out any essential repair or maintenance work.
16. Responsibilities
Neither the owner nor their representatives can be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown, illness or failure of any public service supply including water, electricity and WIFI or any amenities out of the owners’ control. However, every effort will be made by the owner or their representatives to rectify the problem, acting on the clients’ behalf.
17. Personal Injury, damage or theft
The owners and their representatives will not accept any liability for personal injury, death, loss or damage to personal effects and motor vehicles to the client or any member of the party during the rental of the accommodation. All outside doors, windows and the garage should be closed by key when leaving the villa in order to avoid theft.
18. Force Majeure
The owner regrets that he cannot accept liability or pay compensation where the performance of the contractual obligations is prevented or affected by ‘force majeure’. In these Terms and Conditions ‘force majeure’ means any event which the owner or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, technical problems with transportation, closure of ports and ferries, quarantine, epidemics, weather conditions, government action or other events outside the owners’ control.
19. Building developments/construction
Spain is renowned for building developments/construction. Thankfully, there aren’t any large areas of construction in Canuta Mar itself. It is an established area with no sizeable green field sites. None at all. However, we cannot take responsibility for disruption caused by the building of the odd individual house, or house extensions, or home improvements being carried out by neighbors, in the vicinity of our villa. Spanish law in this area prohibits any noisy building works (even on individual properties) during July & August, but during the rest of the year it is beyond the council, the owner and the agents’ control.
20. Cancellation by the owner
In the unlikely event that the owner has to cancel the clients’ booking, the full villa rental cost will be refunded. Any refund will be restricted to the villa rental cost. The owner is not liable for any cancellation charges for travel arrangements, etc.
21. Keys
Detailed instructions for key collection and directions to the villa will be sent after receipt of final payment.
22. Satellite TV
Satellite television is constantly changing and the owners cannot guarantee which channels will be available to the client.
23. Pets
Pets are NOT allowed.
24. Smoking
Smoking is forbidden in the villa.
25. Information
Whilst the owner has made every possible effort to ensure that the details contained within the web site and other advertising material is accurate, the property may be altered or facilities changed. Any information supplied about the villa and surrounding area has been given in good faith and believed to be accurate. The owner cannot accept responsibility for any inaccuracies contained within this supplied information.
