CASA Bon Aire – Terms and conditions

1. Rental agreement

The villa known as Casa Bon Aire in Calpe is offered for holiday rental in the name of the owner Frank Rummens (later referred to as the owner) to the tenant (the Customer), as booking person on the booking form. All reservations accepted by the owner are subject to these conditions, which are deemed to have been fully accepted by the customer and mentioned by all residents in the agreement.

2. Confirmation

Bookings via e-mail will be confirmed by another e-mail with the rental agreement. This must be signed by the customer and sent back to the owner by e-mail as well as a copy of his passport or identity card. The villa will be held in option for a period of 3 working days from the moment the owner sends the “Rental Agreement” to the tenant. During this time, the customer must ensure that the deposit is transferred by bank transfer. If these conditions are not met, the villa will be made available again in the rental.

3. Payment

A deposit of 30% of the total rental cost as well as the total costs for bed linen, towels and final cleaning is paid at the time of booking. As soon as the down payment has been received by the owner by bank transfer, a booking confirmation will be sent by e-mail stating the balance and the due date. The balance plus a deposit of € 500.00 (see article 14) must be paid 8 weeks before arrival. If the rental takes place less than 8 weeks before reservation, the full rent plus the deposit of € 500.00 is due at the time of booking. If the owner does not receive the payment on time (as stated on the booking confirmation) and has not received any notification from the customer, the reservation will be automatically canceled. Fees for the processing of the payment will be charged to the tenant. Transfers through IBAN bank accounts are free of charge. The deposit will be deducted. It is advisable to postpone reservations for transport until receipt of the booking confirmation.

4. Cancellation by the customer

All cancellations of reservations must be reported by e-mail. The date of cancellation will take effect on the date of receipt. If the cancellation takes place more than eight full weeks before arrival, the deposit will be retained. If the cancellation occurs less than eight full weeks before arrival, the full rental price will be deducted.

5. Changes

Any change to a confirmation reservation requested by the Customer within eight weeks before the start of the rental will result in a supplement of € 30.00 in addition to the possible increase in respect of the revision.

6. What is included?

The rental price of the villa includes accommodation for up to 6 people, the cost of normal consumption of water 5 m³ / week) and electricity (100 kWh / week), gas for hot water 0.5 m³ / week, Wi-Fi, cot and highchair if reserved, maintenance of pool & garden. The kitchen is fully equipped with hob, fridge / freezer, combi-oven, dishwasher, coffee maker, Senseo, crockery, cooking pots, pans and cutlery. The outdoor kitchen offers the use of washing machine, dryer, iron, ironing board, … In the storage room on the ground floor are vacuum cleaner and cleaning equipment.

7. What is not included?

The rental price of the villa does not include personal insurance, travel insurance, transport or transport to and from the airport. Rental of linen and towels is mandatory: € 20.00 / person / stay. Final cleaning is mandatory: € 150.00 / stay. The cost for incidental excess consumption of water
€ 5.00 / m³- of electricity: 0.30 € / kWh- of gas for central heating in winter: € 5.00 / m³. The meter readings will be recorded both on arrival and on departure (please note: do not use air conditioning with open windows / doors!).
The cost for gas consumption for the central heating in the winter period is not included. When you arrive on the first day of your holiday after 11 pm, or if you arrive on a Sunday, an additional 15 € must be paid to our local representative at check-in. If you leave before 7 am on the last day of your holiday, or if you leave on a Sunday, an additional 15 € must be paid to our local representative at check-out.

8. Complaints

In the unlikely event that there is a complaint about the villa or its contents during the stay, this should immediately be reported to the local representative by telephone. He / she will take the necessary, reasonable steps to resolve the issue. The owner, or his representative, can not be held liable for any complaints reported after the booking period.

9. Occupation

The villa will be ready from 16: 00h. on the date of rental commencement. Upon arrival, the customer checks whether the villa and inventory are complete / undamaged. Missing / damaged items must be notified within 24 hours to our representative after arrival. He / she will do everything possible with a view to replacement / repair.
The villa must be vacated by 10 am. on the date of the end of the house in order to be able to guarantee final cleaning and preparation for the newcomers. Our representative will inspect the house to record the inventory and status. Upon departure, it falls under the responsibility of the customer to leave all remote controls for TV, satellite decoder, radio, air conditioning units, access gate urbanization and keys of doors and garage door in the villa.

10. Maximum number of persons

Under no circumstances should more than 6 people than those mentioned in the rental agreement remain in the villa, unless with the prior written consent of the owner. The villa may not be rented / sublet to another group / party without written permission from the owner. The owner and his representatives reserve the right to refuse access to the villa to the customer and his party if these conditions were not met. Upon arrival, the customer will be asked to identify himself by showing the lease and the passports of all members of the party.

11. Responsibilities of the customer

The customer must take care of the villa and its contents. The villa and all equipment, kitchen utensils, furniture, etc., must be left clean – as at the start of the rental. The customer realizes that the villa is not a hotel; there is only final cleaning and no daily cleaning provided. The customer must ensure a neat status on departure, including clean dishes, an empty dishwasher, all kitchen appliances cleaned and the barbecue cleaned ready for the next customers. He must also ensure that the complete inventory is at the intended location, that all household waste including bottles, cans, plastic, cardboard and paper are taken to the foreseen waste containers (location: see house rules). Additional cleaning costs or costs for reorganization of the inventory will be deducted from the deposit.
The main tenant ensures that no member of the party engages in an activity in or around the swimming pool that causes nuisance to the neighbors, causes contamination of the water or causes damage to the structure or filtering equipment of the swimming pool. This also applies to unacceptable, anti-social behavior.
Finally, the customer ensures that no object is removed from the house.

12. Insurance

The rental price of the villa does not include personal insurance of any kind. It is highly recommended that the tenant take out insurance for himself and for the party against cancellation, personal accidents and medical costs (in other words, a complete travel insurance).

13. Damage to the villa

Unless in the case of normal wear and tear, the customer is held responsible for damage to the villa or its contents as a result of negligence, willful damage or irresponsible behavior of the party staying in the villa or their guests. Such damage must be reported immediately to the local representative or directly to the owner. Costs of repair or replacement must be accepted and paid by the customer. All disputes between owner and customer are tried before the Belgian Court.

14. Guarantee

A guarantee of € 500.00 is requested against damage to the villa, the furniture, occasional overconsumption, extra cleaning or reorganization of inventory. If the villa is left neatly on departure, no occasional overconsumption of electricity (more than 100 kWh) nor of water (more than 5 m³) or gas, if nothing is damaged, removed or broken, the deposit will be returned to the customer within the 2 weeks after departure. The owner reserves the right to repair or replace damaged items and to deduct any associated costs from the deposit. Breakage, loss or damage can lead to a delay in the reimbursement of the guarantee until the repair / replacement has been carried out. If the guarantor is insufficient to cover the costs for repair / replacement, the customer is held liable for any additional costs.

15. Right of access

The owner, his representative or their subcontractors are entitled at all times to access the property to inspect the premises and to carry out necessary repair or maintenance work in consultation with the customer to respect his privacy.

16. Responsibilities

Neither the owner nor his representative can be held responsible for all circumstances beyond his control including mechanical failure or failure of a utility such as water, electricity and WIFI or other facilities outside the control of the owner. However, the owner or his representative will – in the name of the customer – do everything possible to correct the problem.

17. Personal injury, damage or theft

The owner and his representative can not be held liable for personal injury, death, loss of or damage to personal belongings and vehicles of the customer or of a member of the party during the rental of the villa. To prevent theft, all exterior doors, windows and the garage door must be closed when leaving the villa.

18. Force majeure

The owner can not be held liable or obliged to pay any form of compensation if the execution of the contractual obligations is prevented or influenced by ‘force majeure’. In these General Terms and Conditions, “force majeure” means: any event that the owner or supplier of the service (s) in question could not foresee or prevent, even with the necessary care. Such events may include, but are not limited to; war, war threat, civil riots or conflicts, hostilities, strikes or other industrial conflicts, natural disasters, fire, force majeure, terrorist activities, technical problems with transport, closure of ports and ferries, quarantine, epidemics, weather conditions, governmental measures or other events beyond the control from the owner.

19. Project developments / construction

Spain is known for project developments / construction. Fortunately, there are no major construction projects in Canuta Mar itself. It is an established region without significant Greenfield sites. Neither the owner nor his representative can be held responsible for the failure caused by the construction of an individual house, extensions or improvements to houses located in the vicinity of the villa. The Spanish legislation prohibits noisy construction work in this region (even on individual property) during the months of July and August. During the remaining months of the year, noisy construction work falls outside the power of the municipality, owner and real estate office.

20. Cancellation by the owner

In the unlikely event that the owner has to cancel the booking of the customer, the full rental price of the villa will be refunded. Refunds are limited to the rental price of the villa. The owner is not responsible for any form of cancellation costs for travel arrangements, etc.

21. Keys

Detailed instructions for handing over the key and directions to the villa will be sent after receiving the balance.

22. Satellite TV

Satellite TV is constantly changing. The owner can therefore never guarantee which channels will be available to the customer.

23. Pets

Pets are NOT allowed.

24. Smoking

Smoking in the villa is forbidden.

25.Information

While the owner has made every effort to ensure that the details on the website and in other publicity are accurate, the property may be subject to change or its facilities may have changed. All information about villa and surroundings was given in good faith and with the assumption to be correct. The owner is not responsible for any inaccuracies stolen in the information provided.
